"Earth Day TV Giveaway” Game Official Rules
A product purchase will not affect your chances of winning a prize.
1. Game Period: Game begins on 4/4/08 and ends on 4/30/08.
2. To Play: Consumers who receive a free sweepstakes card at the TCP SpringLight booth (located at Green Apple Festival and NAESP) can visit www.springlightstore.com for a chance to enter the sweepstakes after completing their order of any product(s) offered. Consumers will be prompted to enter the game code located on the back of their sweepstakes card along with their contact information for prize awarding purposes.
3. No Purchase Necessary: To enter the sweepstakes without making a purchase, send a self-addressed, stamped #10 envelope to: Earth Day TV Giveaway, TCP, Inc., ATTN: Education Office, 325 Campus Drive, Aurora, OH 44202. Vermont and Washington residents may omit return postage. Mail-in entries must be postmarked by 4/30/08 and received by 5/12/08. Limit one request per outer mailing envelope. A product purchase will not affect your chances of winning a prize.
4. Eligibility: Game is open to residents of the United States who are 18 years of age or older. Void where prohibited by law. All sweepstakes cards are available while supplies last. Employees of TCP, Inc. ("Sponsor"), their franchisees and their respective partners, affiliates, subsidiaries, advertising and promotion agencies, game piece suppliers or judges (collectively "Game Parties") and any other individual or company involved in the development or execution of the game at any time during the Game Period and the immediate family members and/or those living in the same household of each are not eligible.
5. General Game Rules:
a. Sponsor and Game Parties are not responsible for incomplete, lost, late, damaged, postage due, illegible or misdirected mail or damaged game pieces.
b. If, for any reason, the Game cannot be conducted as planned by reason of unauthorized intervention, technical failures, or any other causes beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this game, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the game.
c. All federal, state and local taxes are the sole responsibility of winners. All federal, state and local laws and regulations apply to this game.
d. All prize winners may be required to complete an Affidavit of Eligibility/Release of Liability and, if legally permissible, Publicity Release within 14 days of notification as a condition to receipt of their game prize. Noncompliance within this time period or return of any prize/prize notification as undeliverable may result in disqualification. Acceptance of prize constitutes permission to the sponsors and their agencies to use winner's name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law.
e. Prizes are non-transferable and have no cash redemption or equivalent. Sponsor reserves the right to substitute a prize or prize component of equal or greater value should a prize or any component of a prize become unavailable.
f. By participating in this game, entrants agree to be bound by the Official Rules and the decisions of the judges.
g. Sponsor and Game Parties are not responsible for any typographical or other error in the printing, the offering or the administration of the game, or in the announcement of prizes. By participating in this game, entrants agree to release and hold harmless Sponsor and Game Parties (including but not limited to their franchisees, their partners, affiliates, subsidiaries, promotion, fulfillment, judging agents and agencies and each of their respective parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees), from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, (1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; or (2) participation in the game or any prize related activities. Sponsor and Game Parties make no representation or warranties concerning the appearance, safety or performance of any prize awarded.
h. Sponsor may collect your name, address, phone number and e-mail address for purposes of administering your participation in this game. At the time you are entering the game, we may also ask your permission to send you future marketing information. Game participants will be provided an opportunity to opt out of receipt of this marketing information or from the sharing by Sponsor of your personal information with our promotional partners or other third parties.
6. Verification: All Game Piece claims are subject to verification by Sponsor, whose decisions are final. All material submitted becomes the sole property of the Sponsor and will not be returned. Sweepstakes codes which are distributed where prohibited by law or not obtained pursuant to official game rules and procedures will be null and void.
7. Prize: GAME PRIZE & APPROXIMATE RETAIL VALUE (ODDS OF WINNING DEPEND ON NUMBER OF ENTRIES RECEIVED):
a. (1) Grand Prize – Phillips 42” Flat panel Television (Approx. Retail value of $1300)
b. Prizes consist only of those items specifically listed as part of the prize. Any expenses not specified herein (including but not limited to income tax and all other costs incurred in claiming prize) are the sole responsibility of the winner. In the event of unavailability of prize, Sponsor reserves the right to substitute a prize of equal retail value selected in its sole discretion.
8. Winner's List: For names of major prize winners, send a stamped, self-addressed, #10 envelope to: Earth Day TV Giveaway Winners List, TCP, Inc., ATTN: Education Office, 325 Campus Drive, Aurora, OH 44202. Winner’s list requests must be received no later than 6/1/08.
